Terms of Service

These Terms of Service ("Terms") govern your use of apex-ai-automation.net and the Apex AI assistant (the "Service"), provided by Apex AI Automation ("Apex AI," "we," "us"), which is operated by an individual based in Ukraine. By using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use Apex AI

You must be at least 13 years old to use the Service. If you're under 18, you may use it only with a parent or guardian's permission, and they agree to these Terms on your behalf. You can't use the Service if you're barred from doing so under applicable law.

2. The Service

Apex AI is an AI assistant that helps with writing, planning, and other tasks. The free plan includes a limited number of messages per day, currently 10 without an account and 30 with an account. We may change these limits and the features of the Service at any time.

Paid plans aren't available yet. Joining a waitlist doesn't guarantee that a plan will launch, or its price, features, or availability. Cancellations and refunds for paid plans are covered by our Refund Policy.

Invite bonuses. You and a friend who signs up with your invite link each get extra free messages per day. Your bonus starts once the friend sends their first message and applies to a limited number of friends. Bonuses have no cash value, and we may change or end the program. Creating fake or duplicate accounts to collect bonuses isn't allowed, and we may remove bonuses gained that way.

3. Your account

Give accurate information when you sign up and keep your password secure. You're responsible for activity on your account. Tell us at support@apex-ai-automation.net if you think someone else has accessed it.

4. Acceptable use

You agree not to use the Service to:

• Break the law, or help others do so.
• Harass, threaten, defame, or harm anyone, or create content that sexually exploits minors.
• Create malware, spam, scams, or content meant to deceive people.
• Infringe anyone's intellectual property or privacy rights.
• Get around usage limits or security measures, including by creating multiple accounts or using bots, scripts, or automated access.
• Resell the Service, or copy, reverse engineer, or interfere with it.

We may remove content and suspend or close accounts that violate these rules.

5. AI output

AI replies are generated automatically and can be inaccurate, incomplete, or out of date. They aren't professional advice, including legal, medical, or financial advice. Check important information yourself before relying on it. You're responsible for how you use what the Service produces.

6. Your content

You keep ownership of the messages you send. You give us permission to process them, and to store them if you're signed in, so we can provide the Service. Subject to these Terms and applicable law, you may use the replies you receive. Other users may receive similar replies.

7. Our rights

The Service, including the Apex AI name, logo, and website, belongs to us. These Terms don't give you any rights to them other than using the Service as described here.

8. Ending your use

You can stop using the Service at any time. To delete your account, email support@apex-ai-automation.net from the address on the account. We may suspend or end your access if you violate these Terms, or if we stop offering the Service.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the fullest extent permitted by law, Apex AI won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue. Our total liability for any claim related to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places don't allow these limits, so they may not apply to you.

11. Indemnity

If you break these Terms or the law while using the Service, you agree to cover the losses and reasonable legal costs that result for Apex AI, to the extent permitted by law.

12. Changes to these Terms

We may update these Terms. We'll change the "Last updated" date above, and for significant changes we'll give notice on the site or by email. If you keep using the Service after changes take effect, you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules. This doesn't take away any protections you have under the mandatory consumer laws of the place where you live.
